En contestación a la Pregunta Escrita P.E./2557, Núm. Registro de entrada 5405, formulada a la Junta de Castilla y León por los Procuradores, D. Fernando Pablos Romo, Dª Alicia Palomo Sebastián y D. Pedro González Reglero, del Grupo Parlamentario Socialista de las Cortes de Castilla y León, relativa a:

1. “¿A qué ayuntamientos de Castilla y León les ha solicitado el ECyL el reintegro total o parcial de la subvención que les fue concedida al amparo de la ORDEN IEM/770/2022, de 23 de junio? En cada caso, ¿cuál ha sido la causa de dicha solicitud?

2. ¿Considera la Junta de Castilla y León que la fecha de publicación de esta orden facilitó a los ayuntamientos la gestión de las contrataciones de personas de discapacidad, mediante la realización de obras y servicios de interés general y social?”

1.- La Orden IEM/ 770/2022, de 23 de junio (BOCyL nº 123, de 28 de junio) establece las bases reguladoras de las subvenciones destinadas a Entidades Locales de la Comunidad de Castilla y León, como apoyo a la contratación de personas con discapacidad, mediante la realización de obras y servicios de interés general y social. Dicha Orden ha sido modificada por Orden IEM/530/2023, de 28 de abril, (BOCyL nº 81, de 28 de abril).

Al amparo de la citada Orden se dictaron tres Resoluciones de convocatoria:

- Resolución de 18 de julio de 2022 (extracto BOCYL nº 139 de 20 de julio de 2022).

- Resolución de 25 de mayo de 2023 (extracto BOCYL nº 102 de 30 de mayo 2023).

- Resolución de 9 de mayo de 2024 (extracto BOCYL n° 93 de 15 de mayo de 2024).

Para los años 2022, 2023 y 2024 respectivamente.

El periodo subvencionable y el plazo de justificación de las respectivas convocatorias son los siguientes:

De las 945 entidades objeto de concesión, 346 de ellas han incumplido las condiciones establecidas en la subvención y por tanto han sido objeto de reintegro. Y el importe cancelado supone un importe 117.455,39 € de los 5.415.129,19 € concedidos, un 2,17 % de la cantidad concedida.

Actualmente, se está liquidando la convocatoria de 2023, los reintegros tramitados hasta la fecha del presente informe son los siguientes si bien todavía quedan expedientes por liquidar.

La mayoría de los reintegros se producen como consecuencia de una justificación insuficiente por parte de la Entidad, bien porque certifica un importe inferior al concedido, bien porque contrata por un periodo inferior al establecido en las bases reguladoras y en la convocatoria.

Los reintegros totales se deben en su mayor parte a falta de presentación de la justificación, no realización de la actividad objeto de subvención o contratos por periodos inferiores al mínimo exigible y que conlleva una cancelación total de la subvención.

La convocatoria de 2024 está en fase de concesión habiendo resultado beneficiarias un total de 1.015 entidades por un importe concedido de 6.633.330,29 €. Con un periodo subvencionable 1 de mayo a 31 de diciembre de 2024.

2.- La línea de ELEX se convocó hasta el año 2021 cofinanciada con el FSE al 50 %, a partir de ese momento la Junta de Castilla y León considera imprescindible seguir promoviendo la contratación de personas con discapacidad por parte de las Entidades Locales asumiendo con fondos propios su financiación. No obstante, este cambio obliga a un cambio de regulación normativa de ahí el dictado de la Orden IEM/770/2022 de 23 de junio y de la Resolución de 18 de julio de 2022 (extracto BOCYL nº 139 de 20 de julio de 2022).

El periodo subvencionable establecido en la convocatoria de 2022 abarca desde 1 de junio a 31 de diciembre de 2022, tiempo más que suficiente para contratos de 90 días ya que son 6 meses de periodo subvencionable lo que deja margen suficiente a las entidades para la contratación de los beneficiarios de estos contratos.
